These pages describe the UpLearnCash financial education platform and its cashback program, available to consumers across Canada, subject to applicable provincial law.
These Terms & Conditions govern the relationship between UpLearnCash and any individual seeking access to its online financial education platform (the "Platform") and its cashback program. By registering, the individual ("Member") acknowledges and agrees to be bound by all provisions outlined below, as well as by the membership agreement signed at enrollment.
UpLearnCash provides an online financial education platform and an associated cashback program, as more fully described in the membership agreement provided at enrollment. The service is intended for individual consumers and is not free of charge under any circumstances. UpLearnCash is not a financial planning firm, a lender, or a credit counselling service, and does not provide personalized investment or credit advice.
To gain access to the Platform, prospective Members must meet the following criteria:
Submission of a registration request does not guarantee platform access. UpLearnCash may decline an application at its discretion, in compliance with applicable human rights and consumer protection legislation, and is not obligated to provide an exhaustive justification for declining an application, except where required by law.
Once a membership agreement is in effect, UpLearnCash may suspend or terminate a Member's access only in accordance with the terms of that agreement, including the provisions governing default and termination. UpLearnCash will not suspend or close an active Member's account without prior written notice, except in cases of suspected fraud, illegal activity, or a material breach of these Terms, in which case notice will be provided as promptly as reasonably possible under the circumstances.
These Terms & Conditions operate in conjunction with the membership agreement signed by the Member and any other applicable policies referenced herein. In the event of a conflict between these Terms and the membership agreement, the membership agreement governs with respect to the Member's specific enrollment.
UpLearnCash offers a cashback program to enrolled Members, the terms of which (including eligibility, vesting, forfeiture, and repayment mechanics) are set out in full in the membership agreement signed by the Member at the time of enrollment. The cashback is a conditional promotional rebate and does not constitute a loan, debt, advance, or consumer credit product.
To process a Member's registration and provide the Platform, UpLearnCash collects personal information as described in our Privacy Policy. By registering, the Member authorizes UpLearnCash to use this information for account management and service delivery purposes, and to share it with service providers strictly as needed to operate the Platform, subject to the limitations and safeguards described in our Privacy Policy.
This agreement is governed by the laws of the Member's province of residence and the applicable federal laws of Canada. Nothing in these Terms is intended to limit or exclude any right or remedy available to the Member under mandatory consumer protection legislation of their province of residence. For any matter not governed by such mandatory provincial provisions, the parties agree to submit to the exclusive jurisdiction of the courts of the judicial district of Montreal, Province of Quebec.
Right of Resolution: In accordance with applicable provincial consumer protection legislation, the Member may resolve their membership agreement without charge within the cancellation period prescribed by the laws of their province of residence (commonly 10 days from the conclusion of the agreement) by submitting written notice to UpLearnCash. The precise period and procedure applicable to the Member are set out in the membership agreement. Additional cancellation and termination rights are also set out in that agreement.
UpLearnCash reserves the right to amend these Terms & Conditions. Members will be given advance written notice of any material change and an opportunity to review the update before it takes effect. Where a change increases a Member's obligations or reduces UpLearnCash's obligations under an active membership agreement, the Member may decline the change and terminate their membership without charge, in accordance with the terms of that agreement. Continued use of the Platform following notice of a non-material change constitutes acceptance of the revised Terms.
